Below are some common asked about ordinances, they are presented in brief for convenience.

CHAPTER 72 - STOPPING, STANDING AND PARKING

72.06 PARKING LIMITED IN DESIGNATED PLACES.

When signs are placed, erected or installed in a block giving notice of limited parking durations therein, no person shall park a vehicle for longer than the posted duration at any time between the hours of 9:00 am and 5:00 pm, of any day, except Sundays and public holidays, upon any of the streets of the block so designated, and the changing of the position of a vehicle from one point directly to another point, within the same block , shall be deemed as one continuous parking period.  For the purposes of this ordinance, the term "block" shall mean both sides of a street between two cross streets (e.g. both sides of N. Trade Street between Maple St. and Palmer St.).

72.14 LAW ENFORCEMENT VEHICLE STANDS. 

Such number of spaces near the Police station properly marked shall be reserved as stands for law enforcement vehicles and no other vehicle shall park there at any time.

72.16 PARKING VEHICLES WITHOUT REGISTRATION.

It shall be unlawful to park or store any vehicle on any public street, alley, sidewalk or on any public right-of-way without displaying a current license plate.

 

CHAPTER 74 - TRAFFIC SCHEDULES

Schedule II  Speed Limits

(B) Pursuant to the authority of G.S. 20-141(f), it shall be unlawful to operate a vehicle in excess of 25 miles per hour on the following streets and highways:

(C) Pursuant to the authority of G.S. 20-141(f), it shall be unlawful to operate a vehicle in excess of 35 miles per hour on the following:

Schedule III  Prohibited Turns.

    (A) Left turns are prohibited at the intersection of Trade Street at Pacolet Street.

    (B) No complete U-turns shall be made at the following intersections:

            (1) Between intersections on any street in the business zone, except at designated turnarounds.

            (2) Maple Street and Trade Street.

            (3) Pacolet Street and Oak Street with Trade Street.

            (4) Palmer Street and Trade Street.

 

 

CHAPTER 75 - PARKING SCHEDULES

Schedule I  Limited Parking.

Street Location Side Time Description
Trade Street From R/R tracks to Stott's Ford Both Sides Two-hour parking between 9:00am and 5:00pm. Monday through Friday
Pacolet Street   Both Sides Two-hour parking time limit.  Spaces currently having a ten-minute parking limit shall continue to have a ten-minute parking limit.  These limits apply between 9:00am and 5:00pm.  Monday through Friday.
Maple Street From Trade Street to Palmer Street   Two hours for all on-street parking spaces except for the two spaces located in front of Brock's Cleaners, which shall be for loading only and shall have a ten-minute limit.
North Trade Street In front of Stott's Ford   Two hours during the period of 9:00am through 5:00pm.  Monday through Friday.

 

CHAPTER 90 - ABANDONED MOTOR VEHICLES

90.01 ADMINISTRATION.

(A) The Police Department and Town Building Inspector of the Town shall be responsible for the administration and enforcement of this chapter.    

          (1) The Police Department shall be responsible for administering the removal and disposition of vehicles determined to be "abandoned" on the public streets and highways within the town, and on property owned by the town.   

          (2) The Town Building Inspector shall be responsible for administering the removal and disposition of "abandoned," "nuisance" or "junked motor vehicles" located on private property.   

(B) The town may, on an annual basis, contract the private tow truck operators or towing businesses to remove, store and dispose of abandoned vehicles, nuisance vehicles and junked motor vehicles in compliance with this chapter and applicable state laws.

(C) Nothing in this chapter shall be construed to limit the legal authority or powers of officers of the town Police Department and Fire Department in enforcing other laws or otherwise carrying out their duties.

 

CHAPTER 91 - ANIMALS

91.04 RESPONSIBILITY OF ANIMAL OWNER.

(A) Owners are responsible for all the acts of their dogs, cats or other animals.  The owner of any dog, cat or other animal which commits a nuisance upon the property of another person, or which damages another person's property or person, is fully responsible and accountable for these acts.

 (B)(1) It shall be unlawful for any dog owner not to keep every dog four months of age or older in a substantial enclosure at all times unless: (a) Such dog has been immunized against rabies in accordance with state law and with an approved anti-rabies vaccine administered by a licensed veterinarian; and (b) Such dog is wearing a collar with a current rabies vaccination tag having a number corresponding to the number on rabies vaccination certificate in possession of the owner.                         

        (2) The above shall not be construed to mean that a dog can be maintained within an enclosure without obtaining the required rabies vaccination.

(C) It shall be unlawful for any dog owner to permit a female dog to run at large during the erotic stage of copulation.

(D) When a dog or other animal becomes vicious or a menace to the public health, the owner of such animal or person harboring such animal shall not permit such animal to leave the premises on which kept unless on leash in the care of a responsible person.

(E) An owner having knowledge that his dog or other animal has theretofore bitten any person so as to break the skin, must keep the same in a secured enclosure or must keep the same at all times leashed or under his direct control.

(F) It shall be unlawful for any person to tease, molest, bait or in any way bother any dog or other animal not belonging to him or legally under his control.

 

91.07 RUNNING AT LARGE PROHIBITED.

It shall be unlawful for any person to permit or allow any dog, cat or other animal to run at large within the corporate limits of the town. 

 

91.09 SQUIRREL HUNTING AND TRAPPING

It shall be unlawful to hunt, shoot, or trap squirrels within the corporate limits of the town.

91.12 DOGS ON PUBLIC GROUNDS.

It shall be unlawful for any person to permit or allow any dog upon public park grounds in the Town of Tryon's P-1 Open Space District unless such dog is: 

             (A) physically restrained on a leash no longer than 10 feet in length; or

             (B) confined in a cage or within the enclosed interior of a motor vehcile; or

             (C) under the control of the owner during the conduct of an AKC, UKC or other kennel club or organized dog club trial, show or exhibition.

 

CHAPTER 92 - FIRE PREVENTION; FIREWORKS

92.02 PERMIT REQUIRED FOR OPEN BURNING.

It shall be unlawful for any person to burn or cause to be burned any trash, refuse, shavings, paper, leaves, grass, brush, litter or other materials of any kind within the corporate limits of the town without first obtaining from the Town Manager a written permit disclosing the person authorized to burn a fire, the location of the burning, and any other conditions required by the issuing officer.

92.03 COMPLIANCE WITH STATE LAWS; BURNING PERMIT REQUIRED.

No open burning permit shall be issued which is in violation of any state, local or federal law, and no burning permit shall be issued until the person requesting the permit has obtained a state burning permit.

 

92.50 FIREWORKS.

The sale of fireworks or other pyrotechnical devices shall be prohibited in accordance with state law.

92.51 FIREWORKS AND BLASTING PROHIBITED.

It shall be unlawful to discharge or ignite fireworks or pyrotechnical devices, shoot blank cartridges, cap pistols or other noise-making devices or do any blasts within the town limits; provided, however that this section shall not apply to blasting where the same is performed under a permit issued by the Town Manager or a pyrotechnical display conducted under the provisions of state statutes.

92.99 PENALTY

The violation of any provision of this chapter relative to open burning shall constitute a misdemeanor punishable upon conviction by a fine not exceeding $50 or by imprisonment not exceeding 30 days, as provided in North Carolina General Statute 14-4.

 

CHAPTER 94 - NUISANCES

94.10 UNREASONABLY LOUD NOISE; UNLAWFUL.

It shall be unlawful for any person, firm or corporation to create or assist in creating any unreasonably loud, disturbing sound levels in the Town of Tryon, taking into consideration volume, duration, frequency and other characteristics of the sound.

94.11 PROHIBITED ACTIVITIES.

The following activities, among others, are hereby declared to be unreasonably loud, disturbing sound levels, but said enumeration shall not be deemed to be exclusive:

(A) The playing of any musical instrument or electronic sound amplification equipment in such a manner or with such volume, particularly between 11:00pm and 7:00am, such that a reasonably prudent person would recognize it as likely to unreasonably disturb persons in the vicinity.

(B) The keeping of an animal or bird which makes frequent or long continued sounds, such that a reasonably prudent person would recognize it as likely to unreasonably disturb persons in the vicinity.

(C) The use of any automobile, motorcycle or vehicle so out of repair, so loaded, or in such manner as to create unreasonably loud, disturbing sounds.

(D) The operating of any garage or service station in any residential area so as to cause unreasonably loud, disturbing sounds to be emitted between the hours of 9:00pm and 7:00am on any day.

(E) The creation of unreasonably loud, disturbing sound levels adjacent to any school, educational facility, church or court during normal operating hours, or within 150 feet of any hospital, which a reasonably prudent person would recognize as likely to unreasonably interfere with the working of such institutions, provided conspicuous signs are displayed indicating that such area is a school, educational facility, church, court or hospital area.

(F) The erection (including excavation) demolition, alteration or repair of any building in a residential or business district other than between the hours of 7:00am and 7:00pm on any day, except in the case of urgent necessity of the interest of public safety, and then only under the direction of an appropriate town official.

(G) The use of any electronic sound amplification equipment for advertising or solicitation purposes, except with an appropriate permit.

 

CHAPTER 96 - STREETS AND SIDEWALKS

96.50 HOUSE NUMBERS TO BE DISPLAYED.

(A) It shall be the duty of the owner of each house or building in the town to display properly on the front thereof in a position easily observed, the proper number of his house or building, for the ascertainment of which he shall apply to the Town Manager.
